$10 Million Recovery in Municipal Liability & Motor Vehicle Negligence Case

Ellis & Ellis Attorneys at Law secured a $10 million settlement on behalf of a family involved in a devastating Southern California motor vehicle collision. Attorneys Warren M. Ellis and Crystal R. Ellis represented the plaintiffs in the case, which involved allegations of municipal liability and motor vehicle negligence against the City of San Diego and other parties.

The collision occurred after the plaintiffs’ vehicle was initially struck by an impaired driver and became disabled on the freeway. Approximately one minute later, a police vehicle traveling in a non-emergency capacity struck the disabled vehicle, resulting in a gas tank explosion. The crash tragically killed two occupants and left an 18-year-old passenger with third-degree burns over approximately 30% of her body, along with fractures, permanent disfigurement, and other serious injuries.

Ellis & Ellis challenged the municipality’s position regarding responsibility for the collision and presented evidence addressing the actions of the responding police officer. The matter was ultimately resolved before trial for $10 million, including $300,000 from the impaired driver’s insurance policy and $9.7 million from the City.
